These terms describe what your membership includes, how billing works, how to book a stay, and your cancellation rights. By enrolling and authorizing payment, you agree to them. We may update these terms with notice as described in Section 11.

What you're joining

Auto-renewal consent

I understand this is a recurring subscription. Benson Travel Group, LLC will automatically charge my payment method $115.00 per month (plus any guest add-ons I select), increasing 3% on each anniversary, every month until I cancel. I can cancel anytime by emailing drpaulbenson@yahoo.com or calling 949-500-1670, and cancelling stops all future charges. I have read and agree to the Membership Agreement below.

3-Day right to cancel

You may cancel for any reason within three (3) business days of joining and pay nothing / receive a full refund. To cancel, email drpaulbenson@yahoo.com or call 949-500-1670.

Part B — Membership Agreement

This Membership Agreement ("Agreement") is between Benson Travel Group, LLC ("we," "us," or "Company"), located at 890 W Heritage Park Blvd, Layton, Utah 84041, and the person enrolling ("you" or "Member"). By enrolling and authorizing payment, you agree to these terms.

1. What the membership is

1.1 Your membership entitles you to one (1) stay of up to five (5) nights per Membership Year, for two (2) people, at a participating luxury resort destination selected from then-current availability.
1.2 A "Membership Year" is the 12-month period beginning on your enrollment date and each anniversary after that.
1.3 Accommodations are arranged by the Company through fractional resort shares and other travel inventory it holds or sources. The Company does not own or operate the resorts, and your membership does not give you any ownership interest in any property or fractional share.

2. What is included — and what is not

2.1 Included: resort accommodation for the stay described in Section 1.
2.2 NOT included, and your responsibility: airfare and all transportation; airport and ground transfers; meals, food, and beverages; resort, cleaning, or amenity fees; gratuities; travel insurance; and all local, hotel, and government taxes. Marketing images are illustrative only and do not represent included services.

3. Dues, billing, and automatic renewal

3.1 Dues: $115.00 per month, plus any guest add-ons you select (+$50/month per additional adult; +$25/month per child age 13 or under at the time of travel).
3.2 Annual increase: Your monthly dues and any guest add-on rates increase by 3% on each membership anniversary to account for inflation. This increase is built into your membership and is reflected in your consent at signup; we will also remind you before each anniversary increase takes effect.
3.3 Automatic renewal: Your membership renews and bills automatically every month and your payment method is charged until you cancel. By enrolling, you give your affirmative consent to these recurring charges.
3.4 First payment / 3-day hold: When you join, we initiate your first month's payment but do not finalize (capture) it until your 3-business-day cancellation window has passed. If you cancel within that window (Section 6.1), the charge is released and you pay nothing.
3.5 Other price changes: Apart from the scheduled 3% anniversary increase, we will give you at least 30 days' advance notice before any other change to your dues takes effect, and you may cancel before it applies.
3.6 Failed payments: If a charge fails, we may retry it over the following 15 days and may pause your booking eligibility until your account is current. If dues remain unpaid for 30 days, your membership will lapse and be treated as cancelled going forward.

4. Booking your stay — and when you become eligible

4.1 Booking eligibility. You become eligible to book a Membership Year's stay once you have paid a full year of dues for that Membership Year — either by completing 12 monthly payments or by prepaying the full year's dues. Prepaying lets you book sooner.
4.2 Availability. Stays are subject to availability and must be requested at least 60 days in advance (90+ days is strongly recommended for peak and holiday periods).
4.3 No guarantee of specifics. We do not guarantee any particular resort, destination, room type, or dates. We will use commercially reasonable efforts to fulfill your request or to offer reasonable alternatives.
4.4 Blackout periods and seasonal restrictions may apply and will be disclosed when you book.
4.5 One stay per Membership Year; one-year rollover. You are entitled to one stay per Membership Year. An unused stay may roll over for one (1) additional Membership Year; if it is still unused after that, it is forfeited.

5. Guests

5.1 Guest add-ons must be selected and paid in advance of travel. A child qualifies for child pricing only if age 13 or under on the first day of travel.
5.2 Your total travel party is limited to the capacity of the booked accommodation.
5.3 Check-in age. Some resorts require the registered guest checking in to be at least 25 years old. At least one traveler on each stay must meet the booked resort's minimum check-in age.

6. Cancellation and refunds

6.1 3-business-day cooling-off: You may cancel for any reason within three (3) business days of enrolling. Because your first payment is held and not finalized during this window (Section 3.4), cancelling in time means you are not charged; if any amount was collected, it is fully refunded.
6.2 Cancel anytime (going forward): You may cancel at any time by emailing drpaulbenson@yahoo.com or calling 949-500-1670 — the same way you joined, with no retention steps or hurdles. Cancelling stops all future charges.
6.3 Effect on your current year: After the 3-day cooling-off period, dues already paid are not refunded. If you have become eligible for the current Membership Year's stay and have not yet used it, you may still book it for travel within 60 days of cancelling.
6.4 Refund method and timing: Any refund is returned to your original payment method within 10 business days.
6.5 Otherwise non-refundable. Except as expressly provided in this Section 6 (the 3-day cooling-off) and Section 7 (if we cannot deliver a stay), all dues and other payments are non-refundable.

7. If we cannot deliver (inventory dependency & force majeure)

7.1 The Company's ability to provide stays depends in part on the travel inventory it sources, including fractional resort shares the founder holds. If specific inventory becomes unavailable, we will use reasonable efforts to provide a comparable alternative.
7.2 If we cannot provide a stay you were eligible for in a Membership Year for reasons within our control, you may choose: (a) a comparable substitute stay, (b) a credit of that year's dues toward future dues, or (c) a refund of the dues you paid for that Membership Year.
7.3 Force majeure: We are not liable for failures caused by events beyond our reasonable control (natural disasters, government action, supplier insolvency, public-health emergencies, and the like). In those cases, the remedies in Section 7.2 still apply.

8. Your acknowledgments

8.1 You acknowledge this is a travel membership for access to accommodations — not an investment, security, fractional purchase, or financial product — and that no ownership interest and no financial return is offered or implied.
8.2 You acknowledge the inclusions and exclusions in Section 2, the full-year booking-eligibility requirement in Section 4.1, and that specific resorts and dates are not guaranteed.

9. Eligibility and location

9.1 You must be 25 or older to enroll. (Some resorts require the person checking in to be at least 25, so the primary member must meet that minimum.)
9.2 One membership per household is permitted at this time.
9.3 The membership is not currently offered to residents of California, Florida, Hawaii, or Washington. You confirm that the state of residence you provide at signup is accurate.

10. Transfer

10.1 Your membership is personal to you and may not be resold, assigned, or transferred without our written consent.

11. Changes to these terms

11.1 We may update this Agreement with at least 30 days' notice for any material change. Continuing your membership after the change takes effect means you accept it; you may cancel beforehand.

12. Limitation of liability

12.1 To the maximum extent permitted by law, the Company's total liability arising from your membership is limited to the dues you paid in the 12 months before the claim. We are not responsible for the acts or omissions of resorts, airlines, or other third-party suppliers.

13. Governing law and disputes

13.1 This Agreement is governed by the laws of the State of Utah.
13.2 If a dispute arises, you and the Company agree to first try to resolve it informally by contacting drpaulbenson@yahoo.com and allowing 30 days to work it out.
13.3 If it isn't resolved, disputes will be handled by the state or federal courts located in Davis County, Utah, and you and the Company consent to that venue. Either party may still bring a qualifying claim in small-claims court.
13.4 Nothing in this Agreement waives any cancellation or consumer-protection right that applicable law makes non-waivable.

14. Entire agreement

14.1 This Agreement, together with the disclosures shown at signup, is the entire agreement between you and the Company regarding your membership.
